Amendments and Notice of Fulfilment of Condition

DuProprio notaries strongly recommend using the document Amendments and Notice of Fulfilment of Conditions, which is made up of two separate sections and accompanies the Offer to Purchase.
Amendments to the Offer to Purchase
The first section covers amendments to the accepted Offer to Purchase. The form lists any amendments to the original offer that the buyer or seller want to propose.

A proposed amendment might, for instance, be a lower price, a request for some repairs or even cancelling the offer to purchase because of what the inspection report revealed.
Notice of Fulfilment of Conditions
The second part of the document consists of a notice that the buyer sends the seller after fulfilling the conditions included in the Offer to Purchase. In it, the buyer checks off the boxes next to the fulfilled conditions from the Offer to Purchase.

The notice can also be sent by the seller to the buyer if the buyer fails to submit the notice of fulfillment of conditions. This section of the document makes the final offer unconditional and official, before going to the notary’s office.
Once the buyer and the seller sign section 4 of the document, the property is considered sold, and they no longer have the right to withdraw from the agreement.
